By making a booking with Sophie Carson Photography, you agree to these terms and conditions.

 

 TERMS & CONDITIONS

  1. COPYRIGHT

The Photographer retains the entire copyright of the Photographs at all times throughout the world.

 

  1. OWNERSHIP OF MATERIALS

Title to all Photographs remains the property of the Photographer. The Client is licensed to use the photographs for usage agreed between the Client and the Photographer. The Licence only applies to the Client as stated and shall not be assigned to any third party without the Photographer’s permission. Permission to use the Photographs for purposes outside the terms of the Licence will normally be granted upon payment of a further fee, which must be mutually agreed (and paid in full) before such further use. Unless otherwise agreed in writing, all further Licences in respect of the Photographs will be subject to these terms and conditions.

 

  1. INDEMNITY

The Client shall be responsible for obtaining clearances in respect of third party copyright works, trade marks, designs or other intellectual property and will indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

 

  1. PAYMENT

Payment by the Client will be expected for the commissioned work within 14 days of the issue of the relevant invoice. If the invoice is not paid, in full, within 14 days The Photographer reserves the right to charge interest at the rate prescribed by the Late Payment of Commercial Debt (Interest) Act 1998 from the date payment was due until the date payment is made.

  

  1. EXPENSES

Where extra expenses or time are incurred by the Photographer as a result of alterations to the original brief by the Client, or otherwise at their request, the Client shall give approval to and be liable to pay such extra expenses or fees at the Photographer’s normal rate to the Photographer in addition to the expenses previously having been agreed or estimated

 

  1. DIRECTION

During the shoot Photographer will take account of Client’s reasonable instructions in respect of the shoot brief. If a representative of the Client is present, their instructions will be considered as to be on behalf of the Client. If the Client is not present during the shoot, then Photographer’s interpretation of the brief shall be deemed acceptable to Client.

 

  1. REJECTION

Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition.

 

  1. BOOKING FEE

A non-refundable deposit will be paid to secure the booking. This will be deducted from the final invoice upon completion of work.

 

  1. CANCELLATION & POSTPONEMENT

This contract between the Photographer and the Client shall not become effective until the booking fee has been paid. At this time, the Photographer shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the Client cancels the contract for any reason, all monies paid shall be retained by the Photographer in order to offset their loss of business. Cancellation with less than 48 hours notice will be charged at the full day rate as applicable.

 

  1. DELIVERY & COLLECTION

All goods supplied by the Client will be delivered not more than 2 days before the agreed date, and collected no later than 5pm on the day following the shoot, unless otherwise agreed. If goods are not collected as above, the Photographer reserves the right to charge a storage fee, or dispose of goods as necessary. Delivery and collection times are between the hours of 9.00 am and 5.00 pm, Monday to Friday.

 

  1. APPLICABLE LAW

This agreement shall be governed by the laws of England & Wales

 

  1. VARIATION

 

These Terms and Conditions shall not be varied except by agreement in writing.
